The Supreme Court refused to squeeze the Special Marriage Act (SMA) of 1954 to provide legal recognition to same-sex marriages, saying it can only be accomplished by the legislature and that any attempt by the court to do so would amount to encroaching upon the field set for the legislature.
The five-judge bench presided by Chief Justice of India D Y Chandrachud said The court cannot strike down the provisions of the SMA. The bench also comprises Justices S K Kaul, S Ravindra Bhat, Hima Kohli, and P S Narasimha.
